The alleged driver of a getaway car that was shot at by a since-terminated Berkeley police officer has filed suit against the city for “emotional anguish of getting shot at.”
In a court filing, the plaintiff’s attorneys wrote that their client “was just trying to drive home after a busy day of commuter crime that took him from Vallejo to Berkeley. The police officer fired a shot at his car and terrified him.”
“Already experiencing the stress of being arrested and jailed, our client has been emotionally traumatized by the officer’s attempt to thwart his escape. $5 million is what his family needs to heal.”
City officials were unavailable to comment, but sources commenting on background suggest that a payout using funds allocated for infrastructure may be forthcoming as part of a settlement.
